Terms of Service

About these terms

These terms form a legal agreement between you and Svayam Incarnation Limited ("we", "us", "our"), a company registered in England and Wales, about your use of Viremail, our email, calendar, contacts, notes, tasks, chat and calling service (the "service").

By creating an account or signing in, you agree to these terms and to our Acceptable Use Policy and Anti-Spam Policy, which form part of them. Our Privacy Policy explains how we use your personal data.

If you are using Viremail on behalf of an organisation, you confirm you have authority to accept these terms for it.

Who can use the service

• You must be at least 13 years old. If you are under 18, you should read these terms with a parent or guardian.
• You must not be barred from using the service under the laws that apply to you.
• You must give accurate information when you sign up, and keep it up to date.

Your account and security

• Keep your password, backup codes, passkeys and authenticator device secure. Do not share them.
• You are responsible for what happens on your account. Tell us promptly if you think it has been compromised.
• One person per personal account. Accounts may not be sold, rented or transferred.
• We strongly recommend turning on two-step verification and adding a recovery email. Without a recovery method, we may not be able to restore access if you forget your password.
• If you use end-to-end encryption and reset (rather than change) your password, you may permanently lose access to encrypted messages. See End-to-End Encryption.

Your content

You own the messages, files, contacts, calendar entries, notes and other content you create or store ("your content"). You give us a limited permission to store, process, transmit and display your content only as needed to run the service for you, for example to deliver your mail, filter spam and malware, index it so you can search, and back it up.

You are responsible for your content and must have the right to send and store it.

We do not read your mail except through automated systems (such as spam and malware filtering), when you ask us to help with a support issue, or when the law requires it.

Acceptable use

You must not misuse the service. In particular, you must not send spam, phishing or malware, break the law, harass people, or try to break our security. The full rules are in the Acceptable Use Policy.

The service, storage and availability

• Each mailbox has a storage quota, shown in Settings. When you reach it, you may be unable to receive or send mail until you free up space.
• Sending limits apply to protect the service and other users (see the Anti-Spam Policy).
• We work hard to keep the service available and secure, but we do not guarantee it will be uninterrupted or error-free. We may carry out maintenance, and we may change, add or remove features over time.
• Keep your own copies of anything you cannot afford to lose. You can download messages with IMAP or "Show original".

Third-party services

A few features rely on third parties, such as password breach checks with Have I Been Pwned. These are described in our Privacy Policy. We are not responsible for websites or services outside Viremail that you choose to visit or connect to, including links in emails you receive.

Suspension and termination

We may restrict sending, suspend or close an account if we reasonably believe it breaks these terms, puts other users or the service at risk, or if we are required to by law. Where it is safe and lawful to do so, we will tell you why and give you a chance to respond. See the enforcement section of the Acceptable Use Policy.

You can stop using the service at any time, and delete your account in Settings → Account. Deletion is permanent: your mailbox, messages, contacts, calendars, notes and settings are removed and cannot be recovered. See the Data Retention Policy.

Our responsibility to you

If you are a consumer, you have legal rights in relation to services that are not carried out with reasonable care and skill. Nothing in these terms affects those statutory rights.

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.

Subject to that, we are not responsible for losses that were not reasonably foreseeable, for losses caused by your own breach of these terms, or (if you use the service for business purposes) for loss of profit, revenue, business opportunity or data.

Business customers: our total liability is limited as set out in [Business liability cap (to be confirmed with legal adviser)].

Changes to these terms

We may update these terms, for example to reflect changes to the service or the law. If a change is significant we will tell you in advance, by email to your account or in the app. If you do not agree to the new terms, you can delete your account before they take effect.

Governing law and disputes

These terms are governed by the laws of England and Wales. Disputes will be dealt with by the courts of England and Wales, except that if you live in Scotland or Northern Ireland you may also bring proceedings in your local courts.

If a court finds part of these terms unenforceable, the rest will continue to apply.
